Information on the processing of personal data of users pursuant to article 13 of eu regulation 679/2016 (“GDPR”)

Luxo Time Firenze S.r.l., with registered office in Firenze, via Porta Rossa n. 75/R, fiscal code and VAT number IT07318050486, registered with the Register of Enterprises of Firenze, REA n. 695303 (“Luxo Time”), in its capacity as data controller, use the personal data of the subjects involved in the processing (hereinafter, the “Data Subjects”), and in particular of the users of the Website and of the users buying the Products, as defined in the general terms and conditions of use and sale

Personal data is provided directly by the Data Subject and consists of the following information: 

  • Data provided voluntarily by the Data Subject - The optional, explicit and voluntary sending of data by e-mail to the addresses indicated below or by filling in online forms (for example, by opening an account on the Website, which might be mandatory to buy Products) entails the subsequent acquisition of data relating to personal details (name; surname; date of birth; age; address; e-mail address; mobile number; gender, if indicated), as well as any other personal data included in the request transmitted by the Data Subject.
  • Browsing Data - The computer systems and software used to operate the Website acquire, in the course of their normal operations, some personal data whose transmission is implicit in the use of Internet communication protocols. This information, by its very nature, may allow the Data Subject to be identified as a user by means of processing and association with other data, although it is not collected for the purpose of association with identified users. These types of information may include IP addresses and other parameters potentially identifying the computer environment of the Data Subject. 

1. Purposes of processing and legal basis 

Personal data may be processed for the following purposes: a) selling the Products and providing of the related Services (as described in the general terms and conditions of use and sale); b) replying to requests transmitted by Data Subjects; c) subject to the express consent of the Data Subjects, sending periodic updates on Luxo Time’s activities and promotional communications relating to Luxo Time’s Products and Services; and d) subject to the express consent of the Data Subjects, sending commercial and promotional communications of services and/or products of Luxo Time’s third party partners. 

The legal basis for the processing of personal data is the performance of a contract and the provision of the requested service (for the purposes under a and b) and the consent of the Data Subject (for the purposes under c and d). 

The Data Subject has the right to revoke his or her consent at any time, without, however, affecting the lawfulness of the processing based on the consent given before revocation.

2. Methods of data processing 

Luxo Time informs that, for the purposes referred to paragraph 1, the data of the Data Subjects will also be processed by computer, telematic, paper and manual means, in compliance with the rules of confidentiality and security established by law.

3. Optional provision of data 

The provision of personal data is optional. However, failure to provide personal data for the purposes set out in point 1 letter a) may prevent Luxo Time from providing its Products and Services to the Data Subject. Refusal to consent to the processing for the additional purposes of: sending periodic updates about Luxo Time’s activities, as well as sending communications about events, services and products of Luxo Time or its third party partners under paragraph 1), letters b) and c), will not result in any consequences, except for the impossibility of being informed about marketing and promo-advertising communications for events, services or products of Luxo Time or its third party partners.

4. Data disclosure 

The data of the Data Subject will not be disclosed. 

The data of the Data Subject may be communicated to the following subjects to the extent strictly necessary to achieve the purposes enlisted in this document: i) to coordination, supervision and management bodies of Internet networks; ii) to banking and financial parties used by the Data Subject to pay for Luxo Time’s Products and Services, as well as to subjects operating within such banking and financial parties, for the sole purposes of administrative and accounting management of the contract/relationship and for feedback concerning the execution of payments; iii) to third parties entrusted by Luxo Time, including its consultants and suppliers, to perform certain functions necessary for the sale of the Products and provision of Services (such as sending e-mail, providing business assistance or services to Luxo Time’s clients). 

These parties will have access to the Data Subjects’ personal data necessary to perform such activities (and will not be able to use it for any other purposes) and will be required to process the data in accordance with applicable law. 

These parties will act as data processors appointed by Luxo Time and will be included in a list, which can be known by sending a request to the address given in paragraph 7 of this document.

5. Data retention 

The personal data of the Data Subject will be stored in servers located within the European Union. 

Personal data collected for the purposes of processing indicated in letters (a) of paragraph 1 will be kept for as long as necessary for the sale of the Products and the provision of the Services requested by the Data Subject. In any case, such personal data will be deleted upon expiration of the warranty on the Products (if any) or upon expiration of retention periods established by law (e.g.: those applicable to accounting/invoicing, etc.). 

Personal data collected for the purpose of processing indicated in paragraph 1 letters (c) and (d) will be retained until the Data Subjects revokes consent to receive commercial communications for events, products, services and initiatives of Luxo Time or its partners, or until they request the deletion of their data, except for the exceptional need to retain the data to defend Luxo Time’s rights in connection with disputes existing at the time of the request, or upon public authorities’ request.

6. Rights of the Data Subject 

The Data Subject has the right to: a) interrupt the processing if the personal data is processed for direct marketing purposes, including in relation to services identical to those already provided by Luxo Time (so-called right of objection); b) obtain information regarding the purposes for which the personal data is processed, the period of processing and the persons to whom the data are communicated (so-called right of access); c) obtain the rectification or integration of inaccurate personal data concerning the Data Subject (so-called right of rectification); d) obtain the deletion of personal data concerning the Data Subject in the following cases (i) the data is no longer necessary for the purposes for which it was collected; (ii) the Data Subject has withdrawn their consent to the processing of the data (insofar as it is processed on the basis such consent); (iii) the Data Subject has objected to the processing of personal data where it is processed on the basis of Luxo Time legitimate interest; or (iv) the processing of the Data Subject personal data does not comply with the law. However, the retention of personal data by Luxo Time is lawful if it is necessary for its compliance with a legal obligations or to establish, exercise or defend a right in court (so-called right of deletion); e) obtain that the personal data concerning the Data Subject is retained only in the following cases (i) the Data Subject disputes the accuracy of the personal data, for the period necessary to allow Luxo Time to verify the accuracy of such personal data; (ii) the processing is unlawful but the Data Subject nevertheless objects to the deletion of the personal data by Luxo Time; (iii) the personal data is necessary for the establishment, exercise or defense of a legal claim; (iv) the Data Subject has objected to the processing and Luxo Time is verifying whether the legitimate grounds for processing outweigh those of the Data Subject (so-called right of limitation); (f) receive in a commonly used, machine-readable and interoperable format the personal data concerning the Data Subject, if it is processed under contract or on the basis of the Data Subject’s consent (so-called right of portability).

The Data Subject has the right to resort to the “Garante per la protezione dei dati personali” (Piazza Venezia, 11 - 00187 Roma), in order to assert their rights in relation to the processing of personal data.

8. Changes to the privacy and cookie policy 

Without prejudice to the fact that Luxo Time will not proceed in any case with processing operations other than those expressly authorized and/or requested by each Data Subject, this document may be subject to changes in order to comply with new legal provisions, changes in the policies on the processing of personal data and/or as a result of changes in the characteristics of the services offered by Luxo Time. Any updated version of this Policy will be made available on the Website in the dedicated section: therefore, Luxo Time invites all users to periodically consult the aforementioned section in order to be always informed of the latest version published.

9. Third-party sites 

Third-party websites that can be accessed through the Website are not covered by this document. Luxo Time therefore disclaims any responsibility in this respect. 

The type of data processing by these third parties, as well as their cookie policies, are governed in accordance with the notice provided by these third parties.

10. Cookies

Luxo Time may use cookies in the context of the Data Subject use of the Website. 

A “cookie” is a small string of data containing an anonymous unique identifier code that is sent to your browser by a web server and then stored on the hard drive of your computer. The cookie is then re-read and recognized by the website that sent it whenever you make subsequent connections. Cookies also record certain information about the user’s navigation on a website. Such information may be used to improve the Website’s performance and offer personalized services or advertisements. 

Data Subjects can set their browser to accept or decline cookies. Data Subjects may refuse to accept cookies by modifying the relevant settings on their browser. However, please note that some sections of the Website may not work properly if the Data Subjects decline cookies.

11. Underage data subjects

Luxo Time does not intentionally collect personal information from underage people. 

If anyone has reasons to believe that an underage person provided Luxo Time with personal information, please email Luxo Time. Luxo Time will use delete this personal information.
